General Terms and Conditions for Workshops 
Creaviva Children's Museum

§1 Contractual partner

The contractual partners are Creaviva Children's Museum at Zentrum Paul Klee, Monument im Fruchtland 3, Bern, hereinafter referred to as Creaviva, and the customer. The customer is the person who books a workshop or a guided tour, either for themselves as an individual, as a legal guardian for underage children or as a client of a group, an institution or a company.

§2 Definition of terms

The following offers are understood to be workshops: School workshops, team workshops for teaching staff, institutions and companies, children's birthday parties "Art & Cake", workshops for private groups and interactive guided tours.

§3 Customer groups

The age categories according to the advertisement of the offer apply.

§4 Conclusion of the contract

The customer concludes a binding contract by making a booking. Workshops can be booked electronically (e-mail, website) or verbally. The confirmation from Creaviva by e-mail is considered a binding contract. Workshops are designed according to the individual wishes of the customer.

§5 Due date and payment

School workshops and interactive guided tours
The costs can be paid on site in cash, by TWINT, debit or credit card or against invoice within 30 days after the event. 

Team workshops for teaching staff, institutions and companies
The costs for workshops are invoiced after the event has taken place in accordance with the order confirmation and must be paid within 30 days. Creaviva assumes that invoices are sent to the customer. If the customer wishes a different billing address or a specific breakdown of the invoice, this must be stated when the order is placed (acceptance of offer).

Children's birthday parties "Art & Cake" and workshops for private groups
The amount due must be paid on site. Payment can be made in cash, by TWINT, debit or credit card. In exceptional cases or on express request, the secretariat can issue an invoice; a processing fee of CHF 10 will be charged.

§6 Additional costs

If additional services are used, e.g. higher quality painting surfaces (MDF or canvas) or special requests, these will be charged additionally at cost.

§7 Cancellation conditions

Cancellation by the customer
Cancellations must be made electronically. The date of receipt of the e-mail shall be deemed the date of receipt.

If the customer cancels the event, the following cancellation costs are due:
up to 60 days before the event no costs
59 to 30 days before the event 40 % of the costs
29 to 14 days before the event 60 % of the costs
13 to 1 days before the event 80 % of the costs
If the event is canceled on the day of the event, the total amount is due.

Cancellations by Creaviva:
Cancellation due to force majeure: If a workshop cannot be held for reasons of force majeure or for reasons beyond the control of Creaviva, such as official orders, no claims for compensation can be made. If possible, an attempt will be made to postpone the event. If this is not possible, no costs will be incurred by the customer.

§7 Catering

Eventmakers AG is the catering partner of Zentrum Paul Klee for all catering requirements in the premises and on the grounds of Zentrum Paul Klee and Creaviva. Orders and agreements between the customer and Eventmakers are not part of this contract; these costs will be invoiced separately. The same applies to any additional rental of rooms (e.g. seminar rooms) at Zentrum Paul Klee.
The serving of alcoholic beverages at workshops for private groups or children's birthday parties at "Art & Cake" is not provided. Water and syrup are provided free of charge. Birthday cakes can be organized by Creaviva.

§8 Insurance

Insurance policies such as personal liability and accident are the responsibility of the customer.

§9 Right of use

  1. Photography and filming is permitted without a tripod and with a flash in the public areas for non-commercial purposes. Nevertheless, the following must be observed: It is not permitted to climb on exhibits, benches or display cases; care must be taken to ensure that no other visitors are hindered by the photographs; in the event of publication, the rights to the image of other visitors and museum staff must be observed.
  2. Social media, blogs (private and commercial use): Photos and videos of a visit can be published on social media. References to articles on private blogs are welcome (please send Creaviva an e-mail with relevant links). If editorially possible, Creaviva will share individual contributions on its own channels.
  3. Creaviva's consent must be obtained for any commercial use or publication. Protected logos and trademarks of Zentrum Paul Klee and Creaviva may only be used with prior written consent. Publications with the same content must be submitted in advance for approval.

§10 Place of jurisdiction

The place of jurisdiction is Bern.

§1 Contractual partners

The customer is the person who books a course; either for him/herself as an individual, as a person with parental authority for underage children and young people or as a client of a group.

§2 Definition of terms

Courses are understood to mean the following offers: Open Studio, Family Morning, Children's Forum, FÄGER vacation courses and Courses for Adults.

§3 Client groups

The age categories according to the advertisement of the offer apply.

§4 Conclusion of the contract

By registering, the customer enters into a binding contract. Course bookings can be made electronically (email, website) or verbally. Courses are subject to a minimum number of participants. Creaviva cannot guarantee that the courses will take place. Participants will receive an electronic confirmation if the course is held.

FÄGER vacation courses: Registration for the vacation courses for children and young people takes place via www.faeger.ch. Registrations on the waiting list are also binding. The provisions of the FÄGER apply.

§5 Due date and payment

Registration or booking obliges payment. Depending on the format, the course costs are paid in advance, e.g. for online tickets for the Open Studio, the Family Morning, the Children's Forum, the adult courses, etc., or must be paid at the latest at the start of the course at reception.

FÄGER vacation courses must be paid on site at the start of the course. Payment can be made in cash, by TWINT, debit or credit card.

§6 Cancellation conditions

Cancellation by the customer:
Cancellations by the customer must be made electronically. The date of receipt of the e-mail is deemed to be the date of receipt.

  1. Open Studio and Family Morning: Entries are non-refundable, but the booking can be postponed free of charge until 2 p.m. the day before. In the event of late arrival - 15 minutes or more after the start of the course - the ticket will be forfeited.
  2. Children's Forum: In the case of a quarterly registration, no replacement or refund of a forum morning can be granted for a single non-attendance. In the case of justified, longer-term absences, the missed mornings can be credited towards a new booking. Single admissions will not be refunded, but registration can be postponed free of charge until 2 p.m. on the previous day.
  3. FÄGER vacation courses: The Creaviva is not allowed to accept cancellations; these must be initiated by the parent or legal guardian via the personal FÄGER account. Cancellations up to 5 days before the start of the course are free of charge. For later cancellations or no-shows including illness or accident - including those who have moved up from the waiting list - Creaviva will charge a processing fee of CHF 10.00 per booking in addition to the course fee.
    Exclusion: If a child is excluded for disciplinary reasons, Creaviva is not automatically obliged to refund the fee, but the case will be dealt with as soon as the customer submits a written request for a refund.
  4. Courses for Adults: Cancellations up to 14 days before the start of the course are free of charge. For cancellations 13 days - 1 day before the start of the course, 80% of the course costs will be due or invoiced, and for cancellations on the day of the course, 100% of the course costs will be due or invoiced. A processing fee of CHF 10 per booking will be charged for each withdrawal. This regulation also applies in the event of accident or illness. If the customer finds a replacement person, the cancellation costs and the processing fee are waived.

Cancellation by Creaviva

  1. Cancellation if the minimum number of participants is not reached or if the course leader is unavailable: If the minimum number of participants is not reached or if the course leader is unavailable at short notice, the customer will be refunded the course fee paid in advance; the amount can also be credited to another course. This does not apply if an adequate replacement is found in the event of the unforeseen absence of the course leader.
  2. Cancellation due to force majeure: If a workshop cannot be held for reasons of force majeure or for reasons beyond the control of Creaviva, such as official orders, the customer will be refunded the course fee already paid.

§7 Course confirmation

After attending the course, the customer is entitled to a course confirmation. These are not issued automatically by Creaviva, but on request or as required. If it is not possible to hand in the confirmation at the end of the course, it will be sent subsequently by e-mail.

§8 Insurances
